wk 11: Final evaluation: forced choice

1.       Kristine aleberto – Kristine’s final was to me the best of the bunch. She had all her blogs up, quotes, they were easy to read, and looked like she got a lot out of it.
2.       Cj  jones– the questions that cj made me like hers. Also very clean and easy to read.
3.        Ryan Fernandez- I like the look of his blog, he seemed to have all his questions asked and had pretty good input on them.
4.       Stanley Nolan – her questions and layout made her look very prepared for the final.  Very good input to her questions.
5.       Leslie Rodriguez – very good arguments to her questions
6.       Shantay reaze – liked her questions and how she found her lawyer.
7.       Joanne – had a great start. It seemed to lack some  quotes
8.       Lonnie –  good questions. Lacked some quotes
9.       John –  lawyers answers weren’t that great
10.   Korsyca –  easy to read, liked her questions
11.   Saul – great layout          
12.   Vivian – good quotes, didn’t like the questions

week 11: final evaluation

Answer---à This class has been a great experience and I’ve learned a lot form it. The classroom dynamic here has been learning and having fun at the same time. And I admit that I did have fun in this class. The people in the class were not rude or disruptive; they were here to learn and made it an easier place to be.  Especially when you’re learning things that are so intricate and confusing. I think that I’ve learned a lot of the course competencies that at first, I didn’t think I was going to be able to do. But I have learned that there are a lot of things that go into the laws of media.  I’ve learned that you can’t just go out and make something, call it whatever you want, sell it for any price and sell where ever you want.  There are certain rules and regulations that you have to go through before you can make an invention. Then once you get an invention made, you have to patent it. If you don’t patent it someone could steal your idea and make it their own. Not only does this go for patents but also with trademarks, service marks, and intellectual property. I think that during the duration of this class I have came a long way from knowing barley anything about copyright, patent, and trademark law to knowing a decent amount about copyright, patent, and trademark law. I think that I have deserved at least a C. I have been doing the work and understanding what needs to be done. The reason I didn’t give myself a higher grade is because I am missing some things. I do not have the internet at my house and it was hard for me to make it to the school every time I needed to use it. But if not for the missing assignments I would definitely need a A or B. But I think that a C is low enough to show that I messed up and need to be ontime with my work but also high enough to show that I grasped all the material, I just had some technology peoblems

Robert Kearns is an engineer from detroit. he invented the intemitten winsheild wiper. he wanted to sell his idea to Ford, but instead of buying it, ford stole it. he took them to court and ended up winning 30 million. he died of cancer alone and sad. makes you think how much money can really buy.

eoc wk 9: first amendment and the news

The whole thing with the first amendment and the church burning the Koran hits on so many different levels. The story around this is that some church in Florida is burning the Koran because they don’t believe in what Muslims stand for. Well good for them. They can burn it all they want. Not burning the Koran isn’t going to save any more troops that are serving overseas. They were already fighting for no reason but for financial gain. And this is what’s going on here. This little old church wants more followers for a new cross out front. That’s the bottom line, and if it’s not then all they want to do is hate. Hate people that are not like them. The fact that people are just now starting to get mad over stuff like this in only because we have a president who is against it. I guarantee that people who are complaining now are the same who agreed with bush to fight an oil war. People like to agree instead of think on their own. They say well so and so said this on the news. Well so what. The people who are reporting the new are getting paid by the same people that are paying the president. Almost all parities are tied into some corporate greed machine that fuels their campaign and then there tied together for the rest of the President’s term. So I think in all that this would be happening no matter what, and that this is not a new issue. I think what needs to change is our whole government. The Muslim people don’t like us for a lot more reasons than burning a few books. We need to stop our capitalist ways and become a whole as a community.

1.    1. What would happen if a student used video equipment from his school for financial gain?- I think that if a student used a piece of school equipment for a freelance project and gets paid for it that it should be alright. We go to a school for a certain type of media that is almost infinite in price range. There is no way that a student could get the type of equipment that is needed for a professional shoot. We pay thousands of dollars to be able to use this equipment, but we really cant.


2.    2. If a student is asked by their internship to use their student discount to purchase software or equipment, what could the legal repercussions be? - I think that the student could get into a lot of trouble trying to get software on a discount for his internship. You would be breaking a licensing agreement with the software company.

3.    3. How is using music in my portfolio not copyright infringement?- Im really confused on how when i use music in a portfolio, how is it not copyright infringement?  Im not selling the music for profit, but i am using it for furthering my career. So Im still curious to how Im allowed to do that.

4.    4. How can Freemont Street take a cameraman’s camera if he/she is shooting on Freemont Street.

5.    5. What could happen if a film has a product in it and the company of the company has not been contacted?

6.   6.  While on a production, can a minor be on film without consent from a parent?

7.    7. Why is it illegal to burn a DVD off the internet that you did not purchase?

8.    8. If someone uses some footage that’s not there’s and they don’t give credit to the artist, what could happen?

The rule of the law is that you shall not steal. Since the bulk of my questions where on pretty along those lines of copyright, (Copyrights - consists of a bundle of tights held by the author or developer of an original work of authorship. Nolo, Patent, copyright, & trademark, pg 219.) patent, (Patent - a patent is a right provided by a government that allows an inventor to prevent others from manufacturing, selling, or using the patent owners invention. Nolo, Patent, copyright, & trademark, pg 97) and trademark (Trademark - Manufacturers and merchants use trademarks for the sole purpose of distinguishing their products from those of others in the marketplace, not for any functional purpose) issues. I think we'll stick with that. But even there are some instances that some questions could arise. Like what about unpublished work? Unpublished work - is an original work of authorship that is fixed in a tangible medium of expression but has not yet been published automatically qualifies for copyright protection. Nolo, Patent, copyright, & trademark, pg 302.  So if your going to use something that is not yours, you're going to need permission.  Permission- the reason for acquiring permission is to avoid a lawsuit. The copyright owner controls the use of the work, and a person who uses it without permission could be sued for financial damages.  It is wise to operate under the assumption that all art, music, and writings are all protected by copyright law. Nolo, Patent, copyright, & trademark, pg 282.  You need to be special careful when your going into other countries and using your or you're companies likeness.  International trademark rights - Trademark rights in each country depend soley on the trademark laws of that country; there is no set o international laws.  Nolo, Patent, copyright, & trademark, pg424
